5 Miranda v. Arizona
"Миранда против штата Аризона"Дело в Верховном суде США [ Supreme Court, U.S.], решение по которому (1966) определило, что лицо, подвергнутое аресту, должно быть предупреждено о своих конституционных правах - о праве сохранять молчание ["the right to remain silent"], о праве на присутствие и помощь адвоката ["the right to have a lawyer present"] и праве на бесплатные услуги адвоката штата в случае невозможности оплатить их. Допрос может продолжаться в случае отказа арестованного от этих прав; арестованный в любое время может прекратить отвечать на вопросы. •• Конечно, никакой «бедной Миранды» не было и нет. А было решение Верховного Суда США по делу «Миранда против штата Аризона» (Миранда – фамилия задержанного, которому полицейский не сообщил о его праве молчать). Верховный Суд постановил, что при задержании были нарушены права подозреваемого. С тех пор при аресте полицейский обязан разъяснить подозреваемому его права (Miranda rights). Вот как сформулировано Miranda warning в постановлении Верховного Суда: “Prior to any questioning, the person must be warned that he has a right to remain silent, that any statement he does make may be used against him, and that he has a right to the presence of an attorney, either retained or appointed.” Иногда разъяснение прав называется reading of rights (he was read his rights).
